The Appellate Tribunal, MCD, which deals with illegal construction matters, is a statutory and independent body constituted by the Central Government under Section 347-A of the Delhi Municipal Corporation Act, 1957. Its Presiding Officer is a judicial officer of the rank of District Judge or Additional District Judge, appointed by the Central Government with the concurrence of the High Court. The Tribunal hears appeals under Sections 343 and 347-B of the DMC Act relating to municipal action on building and construction.
The MCD, DDA, NDMC or any other authority has no role in the appointment, transfer or posting of the Presiding Officer; the MCD only provides staff, infrastructure and facilities. The Tribunal therefore functions independently and hears appeals against orders passed by the Commissioner of MCD or delegated officers.
